Terms of Service

These terms govern your use of tushartgallery.shop and any order placed on it. Placing an order means you accept them.

1. Who you are dealing with

This website is operated by Tush Art Gallery, an online retailer based in Bhopal, Madhya Pradesh, India.

2. Using this website

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to provide accurate information and not to use the website for fraudulent activity, unauthorised automated access or interference with its operation. We may refuse or cancel an order where we reasonably believe these terms have been broken.

3. Products, sizes and reproductions

We describe each piece as accurately as we can: finished dimensions, number of panels, format and whether a frame is included. Sizes are nominal and small variations in framing are normal.

Colour reproduction varies between screens and printers, so a print may read slightly warmer or cooler in person than on your device. We can help you compare your wall measurements with the sizes listed for a product, but choosing the piece and the wall fixings remains your decision.

Where a listing reproduces a well-known artwork it is an open-edition reproduction print — not an original, not a signed or numbered edition and not a licensed museum edition. If we identify an error in a listed price or specification before dispatch, we may cancel the affected order and refund it in full.

4. Orders, pricing and tax

An order placed on this site is an offer to buy, which we accept when we dispatch the item. Prices are in Indian Rupees. We are currently not registered for GST, as our business is below the applicable GST registration threshold; GST is therefore not charged separately and no GST tax invoice with a registration number is issued. The amount shown at checkout is the amount payable for the goods. Shipping charges are set out in our Shipping Policy.

5. Payment

We accept UPI and Cash on Delivery only. We do not accept cards or international payment methods, and we do not store payment instruments. Details are in our Payment Policy.

6. Delivery, cancellation and returns

Typical total delivery time is 3-6 business days for metro cities and 5-10 business days elsewhere, including handling of 1-2 business days. These are estimates, not guaranteed delivery dates. Orders may be cancelled free of charge before dispatch. Change-of-mind returns are accepted within 10 days of delivery on the conditions in our Return & Refund Policy, and refunds are processed within 5-7 business days. Those policies form part of these terms.

7. Intellectual property

Unless otherwise stated, the text, original layout elements, original photography and branding on this site are owned by or licensed to Tush Art Gallery and may not be copied or republished without written permission. Where a product image originates with a supplier, it is used to depict the item offered for sale and remains the property of its owner.

8. Consumer rights, warranty and liability

Nothing in these terms is intended to remove or limit any consumer rights or remedies that cannot lawfully be excluded under applicable Indian law.

Except where required by applicable law, we do not provide any additional warranty beyond the return, replacement and refund rights stated in our policies. Any warranty explicitly stated on a product page applies according to the terms shown for that product.

To the extent permitted by applicable law, our liability arising directly from an order will not exceed the amount paid for that order, and we are not responsible for wall damage, fixing costs or indirect or consequential losses.

9. Responsibility and events outside our control

You are responsible for losses caused by fraudulent use of the website or by hanging a piece contrary to the supplied instructions, to the extent permitted by law. We are not liable for delay or failure caused by events beyond our reasonable control, including courier disruption, severe weather, strikes, or failures of telecommunication or banking infrastructure.

10. Law, jurisdiction and complaints

These terms are governed by the laws applicable in India. Consumer rights and remedies available under applicable Indian law are not excluded by these terms. Subject to any consumer jurisdiction or dispute-resolution rights available under applicable Indian law, disputes will be subject to the jurisdiction of the appropriate courts in Bhopal, Madhya Pradesh.

11. Changes to these terms

We may update these terms as the shop changes. The version published on this page when you place an order is the version that applies to that order.
